Property & Financial Issues

Our specialist divorce and family solicitors have wide-ranging experience of resolving financial and property issues in a sensible and pragmatic way.

Reaching a financial settlement that is acceptable to both sides can be difficult, complicated and expensive, so the family law team at Harrison Drury are here to help you every step of the way and also to keep a close eye on the costs, ensuring you are updated at all stages.

The wellbeing of children is at the heart of any property and financial settlement and we deal with child-related concerns sensitively with due regard to the feelings of everyone involved.

The settlement will be influenced by your income and earning ability, savings, housing needs, pensions, how long you have been married (or in a civil partnership), your overall contributions, and your health.

Most cases are settled by negotiation, although our family lawyers have the skills and knowledge to represent you robustly and effectively in court if necessary.

The occupation and ownership of the home is sometimes a difficult issue. If one party cannot buy out the other, we explain the options and possibilities in plain English, ensuring your interests are always legally safeguarded.

The outcome can be very different depending on whether you are married or cohabiting.

  • If you are married, the judge has broad discretion to try to achieve a fair settlement, taking into consideration the parties’ needs, while giving priority to the needs of children under 18.
  • If you are unmarried, the court’s powers are much more limited. But even if a house is just in one name, the other partner can ask the court to legally recognise their financial input.
  • It will also be taken into account where a property has been a home to children.
