Pre-nuptial agreements (pre-nups) set out a couple’s financial arrangements before they get married or enter a civil partnership. Signing a pre-nup is not the most romantic way of starting married life, but it can reduce the cost and upset of disputes if the relationship goes wrong in the future.

Although pre-nups are not automatically binding under English Law, recent divorce cases have made it clear that courts are increasingly taking account of pre-ups in their decision making process.

The court’s role is to look at the broader circumstances and decide on a fair outcome for both individuals. Experience suggests, however, that pre-nups are becoming more central to the court’s final decision. This is especially the case if your circumstances have not changed much since you got married, or if the marriage did not last long.
